Who repairs a community gate depends on the recorded rules (the CC&Rs), but California Civil Code section 4775 sets the default: the association repairs, replaces and maintains the common area. Residents and visitors get in with codes, remotes or passes. The gate must still allow emergency access, and its safety sensors are not optional.
Myth: the gate is always the homeowner's problem
Fact: unless the community's governing documents say otherwise, Civil Code section 4775 makes the association responsible for repairing, replacing and maintaining the common area. The owner of each separate interest is responsible for that separate interest. For exclusive use common area, the owner handles upkeep while the association handles repair and replacement.
A shared entrance gate is normally common area. A gate on your own private driveway is usually yours. Because the CC&Rs can change the default, read them or ask the board before you order any work. This is a plain summary, not legal advice.

Myth: one community code is good enough
Fact: a single code for everyone is easy to run and hard to control. A vendor guide to gate codes notes that a community-wide code is likely to be shared, that managers cannot tell who entered at a given time, and that changing the code means telling every resident.
The options that fix this are individual codes for residents, remotes or transponders, and passes that a resident sends to one visitor for one day or a set schedule. Each option has a cost and an upkeep routine, so a board should pick based on how many homes and how many deliveries the gate sees. See access control for gates for how keypads, readers and receivers differ, and gate intercoms for visitor calls.
Myth: a community gate can stay locked in an emergency
Fact: the California Fire Code asks for more. Section 503.6 says a security gate across a fire apparatus access road must be approved by the fire code official, must have an approved means of emergency operation, and both must be maintained operational at all times. If an electric operator is provided, it must be listed to UL 325.
Your local fire department decides what it accepts, so a board should confirm it before replacing a gate or changing a lock. More in permit and fire access rules.
Myth: the safety sensors can come off if they stop the gate
Fact: DASMA's summary of UL 325 says a vehicular gate operator needs at least two independent entrapment protection means for each entrapment zone, and that all external means must be monitored. A gate that stops or reverses for no clear reason has a sensor problem to fix. Taping over a sensor or wiring around it leaves the gate unsafe.
UL 325 also sorts operators into classes. Class I is for garages or parking areas of a residence with one to four single families. Class II covers commercial locations and multi-family housing of five or more units. The operator on a community gate should be marked for the right class, and a gate company can check the label.
UL 325 gate operators are made for vehicle gates, and DASMA says property owners must give pedestrians a separate way in. If residents squeeze past a closing gate, tell the board before someone is hurt.
Quick answers
Who pays to repair an HOA gate?
By default California Civil Code section 4775 puts repair, replacement and maintenance of the common area on the association, unless the CC&Rs say otherwise. A private driveway gate is usually the owner's cost.
How do visitors get through a community gate?
Common methods are a gate code, a call from an intercom or directory, or a pass a resident sends for one visit. Residents often use remotes, transponders or personal codes.
Does an HOA gate have to open for fire trucks?
Yes. The California Fire Code asks for an approved means of emergency operation on security gates across fire access roads, kept operational at all times. Ask your fire department what it accepts.
Can a gate company bypass the safety sensors?
No. UL 325 requires monitored entrapment protection, and defeating it makes the gate unsafe. A sensor that keeps tripping needs cleaning, aligning or replacing.

What a board should ask for in a repair quote
- The operator brand, model and usage class
- Which sensors were tested and whether any were bypassed
- A test of the emergency access method before the technician leaves
- What the visitor and resident credentials are, and who can add or remove them
- A written list of parts and labor, with the price confirmed after the technician sees the gate
